Mirroring an executive order signed by President Trump last August, the Office of Management and Budget (OMB) has rolled out a major proposal to overhaul 2 CFR 200, “Uniform Administrative Requirements, Cost Principles and Audit Requirements for Federal Awards.”

Published May 28, the proposal reflects key administration themes such as elimination of policies for diversity, equity and inclusion; crackdown on illegal immigration; and more centralized control over federal grantor agencies. OMB claims that the changes will improve transparency and oversight, upgrade the legal status of the OMB guidance as a regulation, and reduce burden and “unnecessary add-ons.”

The OMB proposal is subject to a 45-day comment period ending on July 13. Accordingly, in addition to highlighting the details of the OMB proposal, this webinar will include a “comment clinic” segment suggesting ways to present and support viewpoints from the unique perspectives of recipients and subrecipients.

Key proposal features discussed in the webinar will include:          

  • Instructions to federal agencies about how to assure that new discretionary grant awards reflect administration priorities.
  • Elimination of authority for federal agencies and pass-through entities to issue fixed amount awards and subawards.
  • Introduction of new requirements for grant recipients to obtain permission to take certain routine administrative tasks.
  • Structuring federal grant payment procedures to require written justifications prior to release of cash.
  • Assertion that “termination for convenience” is a step that federal agencies can take even when noncompliance with award terms and conditions is not present.
  • Signals that OMB is reviewing how the single audit requirement is working and the future of the annual OMB Compliance Supplement.
  • Details about how numerous longstanding pre-award and post-award steps would be handled going forward.
  • How indirect cost rate negotiation and recovery may be accomplished in the future
